Terms and Conditions
1. Supply of Story & Picture

1.1. I agree to provide HeadsUp! with the Goods.

2. Your Warranties and Obligations

2.1. I warrant to have the necessary authority and eligibility to enter into this Agreement.
2.2. I consent to the use of the Goods.
2.3. I warrant that the Goods are accurate, true and correct.
2.4. I warrant to also possess the consent of all other parties who may appear or are mentioned in the Goods.
2.5. I understand and acknowledge that the Goods may appear in public via, including but not limited to social media platforms, print media and electronic media (the Mediums).
2.6. I consent to the Goods being displayed via the Mediums, in perpetuity.
2.7. HeadsUp! makes no representation, and you do not rely on same, and you are aware that there is no obligation or guarantee that the Goods will appear via the Mediums.
2.8. You understand and acknowledge that you will not be compensated or receive additional consideration (monetary or otherwise) to the incentive for the Goods.
2.9. You understand and consent to Heads UP! amending, in its absolute discretion, the Goods, to ensure capability and fitness for the Mediums, or as otherwise required.
2.10. You understand and acknowledge that you will not be given the opportunity to receive, inspect or approve, the Goods after the Goods have been submitted.

3. Intellectual Property

3.1. Ownership of all intellectual property rights in the Goods vested in the HeadsUp! Campaign.
3.2. HeadsUp! owns, in perpetuity, all rights and interests in any intellectual property (including copyright in any document, or ownership of any, invention, design, or trademark) that is created in the course of the community awareness raising project.

4. Limitation of Liability

4.1. To the full extent permitted by the law, I will not bring a Claim against the Released Party.
4.2. You will indemnify and forever hold the Released Party harmless should a Claim be made in relation to:

a. intellectual property rights; or
b. failing to obtain consent from or for any other reason a third party whom appears in and/or is mentioned in the Goods brings a Claim; or
c. breach of this Agreement.
5. General

5.1. If any provision of this Agreement shall be unlawful, void for any reason or unenforceable then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provision.
5.2. Claims includes but is not limited to any and all liabilities, claims, demands, legal actions, rights of actions for damages, personal injury or death in connection with participation in the Activity.
5.3. Released Party means the HeadsUp campaign and its associated creative agency and competition entrants 5.4. You/I/Your means the person detailed in the table above.
